COAH Adopts Townhouse Accessibility Requirement

On December 20, 2004, new rules adopted by the Council on Affordable Housing, the agency responsible for administering New Jersey’s Fair Housing Act, went into effect.  Notable among the new substantive rules is N.J.A.C. 5:94-4.21(a), which requires that ten percent of all affordable townhouse units proposed in a municipality’s fair share plan be accessible to people with disabilities.  The Community Health Law Project was instrumental in persuading COAH to add an accessibility requirement to regulations that previously had governed only the affordability of residential housing in New Jersey.
